These Terms and Conditions (“Terms”) govern your access to and use of https://shaimainfotech.com (the “Website”), and any products or services offered by Shaima Info Tech (“Company”, “we”, “us”, “our”), including web design, mobile app development, cloud/hosting services, school management software, and any items purchased through our online Shop. By accessing the Website, placing an order, or engaging our services, you (“Client”, “User”, “you”) agree to be bound by these Terms.

  1. Eligibility
    By using our Website or Services, you confirm that you are at least 18 years old, or accessing the Website under the supervision of a parent/guardian or an authorized representative of an organization (e.g., a school placing an order for School Management Software).
  1. Services Offered
    We provide, among others:
    Website design and development
    Mobile application development (Android/iOS)
    Cloud, web, and WordPress hosting
    School Management Software and related institutional software (e.g., Bonafide Certificate Software, PMS)
    Digital marketing, SEO, CRM, and QR code solutions
    Products sold through our online Shop (e.g., hosting packages, app development packages)
    Service descriptions, timelines, and deliverables for custom projects (websites, apps, software) will be governed by a separate written quotation, proposal, or agreement between you and Shaima Info Tech, which shall take precedence over this general description in case of conflict.
  1. Account Registration
    To place orders through “My Account,” you agree to provide accurate, current, and complete information and to keep your login credentials confidential. You are responsible for all activities that occur under your account. Notify us immediately at admin@shaimainfotech.com of any unauthorized use.
  1. Orders, Pricing & Payments
    Prices listed on the Website/Shop are in Indian Rupees (INR) and are subject to change without prior notice, except for orders already confirmed.
    Placing an order through the Shop constitutes an offer to purchase; we reserve the right to accept or decline any order (e.g., due to stock/capacity limits, pricing errors, or suspected fraud).
    Full or partial advance payment may be required before we commence work on custom projects (websites, apps, software).
    All online payments are processed securely through our third-party payment gateway partner, PayU. By making a payment, you also agree to PayU’s terms of use. See our Payment Gateway & Refund Policy for details.
    An order/service confirmation will be sent to your registered email upon successful payment.
  1. Service Delivery & Client Responsibilities
    Delivery timelines for custom development projects (websites, apps, software) will be specified in the applicable quotation/proposal and depend on timely receipt of content, credentials, approvals, and feedback from the Client.
    The Client is responsible for providing accurate content, images, and third-party licenses (e.g., stock photos, fonts) required for the project, and for ensuring such material does not infringe any third-party rights.
    Hosting services (Web Hosting, WordPress Hosting) are subject to fair usage policies and uptime commitments of our underlying infrastructure/hosting partners, and are provided on an “as available” basis.
    We are not responsible for delays caused by the Client’s failure to provide timely inputs, approvals, or access credentials.
  1. Intellectual Property
    Unless otherwise agreed in writing, all original code, design elements, and materials created by Shaima Info Tech for a project shall be transferred to the Client only upon full payment of all applicable fees.
    Shaima Info Tech retains the right to use general skills, know-how, and non-confidential frameworks/components developed during a project for other clients.
    All content on the Website itself (logos, graphics, text, and design) is the property of Shaima Info Tech and may not be copied, reproduced, or used without prior written permission, unless it relates to your own purchased deliverable.
    Third-party licensed software, plugins, or platforms (e.g., WordPress, WooCommerce) used in a project remain subject to their respective owners’ licenses.
  1. Cancellations & Refunds
    Cancellation and refund terms for orders placed through our Shop, and for custom development/hosting engagements, are set out in our Payment Gateway & Refund Policy, which forms part of these Terms.
  1. Renewals
    Hosting, domain, and software maintenance/support services are typically billed on an annual or periodic basis as specified at the time of purchase. We may send renewal reminders, but it is the Client’s responsibility to ensure timely renewal to avoid service interruption or data loss. We are not liable for consequences arising from lapsed renewals.
  1. Warranties & Disclaimers
    We strive to deliver services with reasonable skill and care in line with industry standards.
    Except as expressly stated in a specific project agreement, our Services and Website are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
    We do not guarantee that the Website or any hosted service will be uninterrupted, error-free, or completely secure, and we are not liable for third-party outages (e.g., hosting infrastructure, domain registrars, payment gateway downtime).
  1. Limitation of Liability
    To the maximum extent permitted under applicable law, Shaima Info Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising from your use of the Website or Services. Our total aggregate liability for any claim arising out of or relating to a specific service shall not exceed the amount actually paid by you for that specific service in the preceding three (3) months.
  1. Indemnity
    You agree to indemnify and hold harmless Shaima Info Tech, its employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, misuse of the Website/Services, or infringement of any third-party rights through content you provide.
  1. Prohibited Use
    You agree not to:
    Use the Website or Services for any unlawful purpose or in violation of any applicable law;
    Attempt to gain unauthorized access to our systems, servers, or another user’s account;
    Upload malicious code, viruses, or engage in activities that disrupt our Services;
    Use our hosting/software services to host illegal, defamatory, obscene, or infringing content;
    Resell our Services without prior written authorization.
    We reserve the right to suspend or terminate access to any account or hosted service found in violation of this clause, without prior notice.
  1. Third-Party Links & Projects
    The Website features links to third-party client websites, apps, and platforms (e.g., Google Play Store, client portfolio sites). These are provided for reference/portfolio purposes only, and we are not responsible for the content, policies, or practices of these third-party sites.
  1. Termination
    We may suspend or terminate your access to the Website, Shop account, or any hosted service, with or without notice, for conduct that we believe violates these Terms, applicable law, or is harmful to other users or our business interests. Custom project agreements may include their own termination clauses which shall prevail for that engagement.
  1. Governing Law & Jurisdiction
    These Terms shall be governed by and construed in accordance with the laws of India. Subject to Section 17 (Dispute Resolution), any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts at Ramanathapuram, Tamil Nadu, India.
  1. Dispute Resolution
    In the event of any dispute, the parties shall first attempt to resolve the matter amicably through good-faith negotiation by contacting admin@shaimainfotech.com. If unresolved within 30 days, either party may pursue remedies available under Indian law, including arbitration if separately agreed in a project contract.
  1. Changes to These Terms
    We may revise these Terms at any time by updating this page. Continued use of the Website or Services after changes are posted constitutes your acceptance of the revised Terms. Material changes affecting an active custom project will be communicated separately.
  1. Severability
    If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
